Labor Law Articles

Labor law began in response to workers' demands for better workplaces and working conditions and the right to organize. In the days of yore, working conditions were so deplorable it was not uncommon for workers to die inside factories or in construction sites. Even worse, while these deaths occurred on the job and while carrying out work-related tasks, companies do not shoulder any of the costs that arise. The labor movement has been primarily responsible for the enactment of legislations that protect labor rights, among them the institution of an eight-hour workday, regulation of the minimum wage, and adherence to a contract of employment. The articles in this section are all about labor law.

Small business owners are faced with a variety of challenges that are simply foreign to their larger counterparts. In a bigger corporate structure, the supervision of financial concerns, human resources needs, and other significant elements of a business operation is typically delegated to separate departments. For most small businesses, however, that level of modular distinction is a prospect in the distant future. Though this can complicate an entrepreneur's life and career simply because it means that he or she must handle so many different tasks, the greater problem is the legal trouble that can arise if a lack of expertise in labor law or other relevant concerns results in violations of the law.

Workman's compensation laws vary from state to state, with each state determining how workers compensation is administered within its own borders. All states have workman's compensation laws, but the laws are slightly different in each state, reflecting the individual needs of employers and employees in that particular state.

In a recent release by the Attorney-General, Robert McClelland, it was announced that the Council of Australian Governments (COAG) has agreed to implement a plan that will see the introduction of a uniform and nationwide regulatory system across the Australian legal profession. Under the COAG plan, it is intended that draft legislation of the proposed new laws will be ready for consideration within a period of 12 months. A specialist Taskforce, as appointed by the Attorney-General, will be charged with the duty of preparing the new legislation and the Taskforce will receive advice from, and be assisted by, a Consultative Group, who will also be appointed by the Attorney-General.

Many jobs are dangerous, and pose a significant risk to your life and health every day. Unfortunately, risks are often unknown to employees, and employees who do know usually don't have the luxury of finding a different job.
